Here's a summary of what Jozef and I have been up to.

(1) Supanova 2009 Professional Development Seminars
The ASA and Supanova will be running a professional development seminar at Brisbane, Sydney and Perth. The title of the seminar is "Legal Self-Defence for Comics Creators: Understanding Comics Contracts". Dr Jeremy Fisher, the Executive Director of the Australian Society of Authors will be the presenter. I have already posted the Qld info on another thread on PulpFaction and am about to do so here.

We apologise to the Melbourne creators for not bringing the seminar to you. Unfortunately, Supanova Melbourne coincides with the ASA's AGM and the first Committee of Management weekend meeting for the year, which Jeremy Fisher needs to attend. We will try our hardest to get a podcast or similar from the other locations so that Victorian attendees don't miss out.

Please note that Jozef Szekeres will be attending Supanova Melbourne in his capacity as the Comics/Graphic Novels Portfolio Holder, and I'll be attending Supanova Brisbane this year (although Jozef may be coming as well – still to be confirmed). We will be going through artists' alley to talk to creators about their needs, but please seek us out if you have any questions. Tim McEwen, Supanova organiser, knows what we look like and can point us out to you.

(2) Minimum Approved Comics Creators' Contract
The draft is being considered now by the contracts committee and Jozef and I will soon get to read over it, provide commentary and help usher it to publication. The contract will be made available for free to ASA members and to non-members for a price. The agreement will also be published in the next edition of Australian Book Contracts, which will be released towards the end of the year. We thank all those Australian creators who we interviewed and who helped us assemble the research material needed for the ASA's legal officer to draft the contract.

We still want to obtain contracts from Marvel, Dark Horse, and IDW if anybody can help out. This can be done on a STRICTLY CONFIDENTIAL basis.

(3) Survey & Rates Sheet
Thank you to Tad Pietrzykowski who has helped us develop a survey, which we will soon up putting up online (we're hoping to do this in April/May). The survey will enable us to compile a profile of the Australian comic community and also provide information that will help us draft a Minimum Freelance Rates Sheet for scripting, pencilling, inking, colouring, covers, and a whole bunch of other categories including convention sketches. We will be asking you to participate so stay alert for future updates.

(4) The Society of Book Illustrators (SOBI) Style File – see http://www.thestylefile.com)
Submissions for the Style File will open on 1 May and close on 28 May 2009. For more information check out: http://www.thestylefile.com/ Comics artists are encouraged to submit their work.

(5) Mentorship Scheme
Mentorship applications open on 1 April and close on 30 April 2009. Entry forms will be available on the ASA website – http://www.asauthors.org – from 1 April. The ASA Mentorship Scheme will be looking to include more comics artists and writers in the 2009 round. Mentors are paid for their mentoring work.

(6) Talent Register
Jozef and I prepared a brief for establishing an online Talent Register for Comics Creators, which will be marketed to book publishers. This initiative still needs to be confirmed by the ASA but we anticipate that once we get final approval then it will be organised for the second half of 2009.

(7) ComicsBiz Ezine
The third issue of ComicsBiz is going out exclusively tomorrow to ASA portfolio members. It has a comics marketing-specific orientation so is different to other journals or information website on offer. Each edition runs a feature article (the March one is on branding yourself), an interview with an Australian comics creator who is an ASA member (Jessica McLeod is being featured this month, and David Blumenstein and Matt Godden appeared in previous issues), Legal FAQ, Marketing FAQ, Recommended Marketing Resources and Must Read Online Articles.

(8) ASA Website
The ASA website now has a dedicated Comics/Graphic Novels Portfolio page where you can find all the latest news and updates. See – http://www.asauthors.org/scripts/cgiip. ... geId=10137.
Members will have special access to other features and benefits within the site but need to obtain passwords.

(9) Membership
Membership is growing but we need YOU ALL to join in order to strengthen our numbers and give us a solid professional platform. Joining the ASA is about protecting your long term professional and business interests, education and about looking after the broader Australian comics community so we can rescue each other and provide support and a soft place to fall in times of need.

IMPORTANT NOTICE: We've arranged a special deal for anybody who signs up for membership during any of the four 2009 Supanovas so talk to Jeremy Fisher, Jozef or me during those weekends.

Understanding Comics Contracts


It’s natural to be overjoyed when you’re offered a publishing contract for your comics project. It’s also natural to be devastated when you realise the contract you’ve signed has left you with little or no claim over the creative property you’ve laboured on for years.

Knowledge is your first line of self-defence against those publishers who weigh contracts heavily in their favour and attempt to deny you basic and intrinsic creator rights. This seminar works towards preventing you from becoming a victim of exploitative deals by introducing you to legal publishing terms and helping you understand the implications of the major clauses in contracts. AN OPEN LETTER TO AUSTRALIAN COMICS CREATORS

Dear Australian Comics Creator,

I am writing to you as a member of the Australian Society of Authors (ASA), representing the recently established ASA Comics/Graphic Novels Portfolio. I am currently undertaking research to create a Rates Card for you and other professional and emerging Australian comics creators for the purposes of commissioned works (otherwise known as work-for hire) agreements. By “comics” I mean anyone who is writing and illustrating comic books, graphic novels, comic/cartoon strips, digital (web) comics and zines (that contain comics/sequential art content). By “professional” I mean anybody who has been paid page rates by a publisher or other entity who has commissioned the work.

We are asking you to fill in a simple survey, which will only take you 10 minutes, and to provide information based upon your own professional experiences. This raw data will remain strictly confidential and will be used with the intention of formulating minimum page rates and to get an understanding of the makeup and profile of the working (and emerging) comics community in Australia. The specific minimum rates we want to develop for the Rates Card are for:

o Concept art sketches (per sketch)
o Comics page/panel/shot design (layout)
o Thumbnails/Roughs
o Pencilling
o Inking
o Colouring (computer or hand)
o Cover Art
o Lettering
o Writing (story synopsis, page breakdown, script)
o Editing (story or art)
o Cartoon/comic strip (print)
o Webcomic strip (digital)
o Zines (with comics – sequential art – content)
o Convention sketches (black and white only)
o Commissioned artwork (one-character piece or landscape or object sourced from comics properties) in black and white
o Commissioned artwork (one-character piece or landscape or object sourced from comics properties) in colour.

Please note that we will be cross-referencing the rates information with those issued by organisations such as the Society of Book Illustrators, Australian Cartoonist Association, and the Media Entertainment and Arts Alliance to ensure consistency.

The purpose of this exercise is to chart a course, lay out a roadmap for those of you who want to make comics your career. The hardest thing in this country is being able to set down a value for the different services that are required in the production of comics. By gathering raw data from as many sources as possible we’re hoping to change that so that in the event a publisher commissions you for a project, you will have access to minimum pay guidelines and negotiate a reasonable fee in keeping with your talents and the time, energy and commitment you put into creating scripts or artwork.

Given my background of having worked 20+ years in the Australian comics world and having been involved in every step of the storytelling process, I was asked to facilitate this project. I would like to think that through co-operation and consultation we might be better prepared for the future of storytelling in the Australian comics landscape.

Attention all Australian comic and graphic novel creators!

Did you know that the National Library of Australia is currently running two projects to ensure that the works Australian comics creators have had published will be collected by the National Library of Australia?

The projects are called Collecting Australian fringe publishing at the National Library of Australia and, the Comics claiming project. They are about the collection and treatment of comics, graphic novels, manga and zines at the National Library. The projects focus on:

– what is being published by Australian creators and publishers, whether published in Australia or not;
– whether we are getting them into the collection;
– if not, how to improve the intake of these material.

How is this relevant to Australian comics and graphic novels creators?

This is relevant to graphic novel and comics creators because the library needs your help to ensure that your work is represented in the national collection. For creators this will mean that a copy of your published work is preserved in a controlled environment and is made accessible to library patrons now and in the future. Information about your works will also be made available, in the form of a catalogue record, to anyone anywhere with access to the internet.

Creators can help the Library simply by telling us about their own (or other peoples if you have the details) published works. Australian (Australian companies and international companies with branches in Australia) publishers are responsible for depositing published works with the library. We call it legal deposit. But many smaller or independent publishers are unaware of their legal deposit obligations or that the library would be interested in the type of material they publish. However if the graphic novel and comics creators tell the library about their published (or soon to be published) works the library can then take steps to acquire this material from the publishers.

The library would also like to hear from creators who are published by non-Australian publishers such as IDW and First Second Books as we also wish to collect works by Australians even when published outside of Australia.

What we would like Australian comics creators to do

To talk to us about your published work just send the relevant information (title, name or names of creators, publisher’s name, date of publication and ISBN if you know it) to us via post or email or call. The contact details are provided below.

The library would also like to hear from you (just use the same contact details) if you wish to discuss any issues or ask any questions in relation to these projects.

How should a theatrical acting portfolio look? I am auditioning for plays in the area, I have 2 headshots I would like to use but need to know what else I should have in my portfolio and how I should put it together. Would putting it in a folder or small binder be okay? What else should go in it? People with experience please let me know.

Sorry, I can't answer that question as theatrical (acting) portfolios are different to art portfolios. I would do a Google search on key words such as "actor's portfolio", "head shots" "theatrical agents" etc and also look at any guilds such as the Actor's Guild in the USA or the Media Entertainment and Arts Alliance in Australia. Their websites might give you pointers.

Excellent work, and the rates cannot be faulted, as they are neither inflated, nor artificially low due to regional concerns.

However, the problem of the abuse of deferral remains. As does the problem of rortage of the "profit-share" systems used in so-called "collaborations". I suggest the following addendums (as provisos) for these suggested rates, to be included as mandatory standard contractual deal points:

1: No member of ASA (or the AWG, or SPAA) may enter into any work-agreement with any artist in Australia in which

A: they do not pay a minimum of 10% of the amount of the pay/page rates owed for the amount of work completed at the applicable minimum rates stated by the ASA established illustration and/or comicbook art rates, and

B: that any use of such art before the 10% "option" is paid is NOT LEGAL and considered both criminal and fraudulent.

In other words, if anyone calling themselves a publisher (even an unpublished author) wants to use a pencilled and inked comic book page (even if only as an attached jpeg in an e-mail pitch to a film production company overseas), they gotta fork up $30 AUSD cash, full stop, or they CANNOT USE THE ART, period.

If they don't like that, they can get some RMIT punk at the Hi Fi Bar or the ACMI cafe to do it for 2 lattes and some rollie-papers.

2: When any deal other than full, proper payment per page is the deal "offered", the writer/publisher/producer MUST - by binding and actionable legal agreement - pay the remaining balance of the FULL PAGE RATE owed to the artist FIRST, from any and all profits generated in any way, from any use of the artists work (including any media development deals from source/location), and may not put ANY OTHER COSTS before the work of the artist who has provided completed artwork.

3: If the writer/publisher/producer is paying less than 50% of the 2010 ASA rates UPON COMPLETION and receipt of commissioned artwork (with payment being defined as actual payment, NOT DEFERRAL in any guise or form), then the writer/publisher/producer commissioning the artist must give the artist 1% of the intellectual property rights (including but limited to copyright, trademark and ancillary exploitation rights and MONETARY PARTICIPATION in all media development and exploitation deals, including but not limited to any further versions of the work to be published or developed by Marvel, DC, Image, Vertigo or any other "comics publisher") for every 1% below the 50% of ASA established 2010 rates.

4:

A: ALL SALES RECEIPTS of any and all uses of work derived in any manner from the art provided by the artist must be tendered to the artist within 24 hours of being received by the writer/publisher/producer who has commissioned the work from the artist, to avoid any "cooking of the books". Additionally,

B: ALL OFFERS MADE on any forms and formats of THE INTELLECTUAL PROPERTY derived, in any way, from the artist, must be CC'd and BCC'd to the artist within 24 hours of receipt by anyone receiving the offer from any party. These include - but are not limited to - television series (both live and animated), webisodes, film deals, shirt deals, development by other comic book publishers (such as Marvel, DC, Dark Horse and Vertigo, etc.)
